5. "Human-in-the-Loop" Mandate & Client Authority

AI Gaur’s automated systems and tools are designed to augment, not replace, human operational judgment. The Client is the final authority on all deliverables.

• Mandatory Review: The Client agrees to perform a "Human-in-the-Loop" review of all AI-assisted code, content, marketing materials, and strategic plans prior to public deployment.
• Accountability: By deploying any deliverable to a live production environment, the Client assumes full responsibility for its accuracy, compliance, and operational impact.

6. Data Training Privacy & 2026 NJDPA Compliance

We respect your proprietary business data and strictly adhere to the New Jersey Data Privacy Act (NJDPA) and federal AI transparency guidelines.

• Zero Public Training: AI Gaur guarantees that no proprietary Client data, source code, or confidential operational metrics will be used to train public Large Language Models (LLMs) or shared with third-party foundational model providers without affirmative, opt-in consent.
• Data Protection Assessments: We conduct rigorous internal audits to mitigate algorithmic discrimination and ensure high-risk automated decision-making processes comply with state regulations.

7. Liability Cap & Indemnification

To the fullest extent permitted by law, AI Gaur’s total cumulative liability for any claims arising out of or related to our services, whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Client to AI Gaur during the six (6) months immediately preceding the event giving rise to the claim.

The Client agrees to indemnify, defend, and hold harmless AI Gaur and its developers against any third-party claims resulting from the Client's public deployment of AI-generated deliverables without proper human verification.

8. Governing Law & Binding Arbitration

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey. Any dispute, claim, or controversy arising out of these Terms shall be resolved via binding arbitration conducted in Middlesex County, New Jersey, adhering to the rules of the American Arbitration Association.

9. Modifications

We reserve the right to amend these Terms of Content Use at any time. Your continued use of the website following any changes constitutes your acceptance of the updated terms.
